he was tried by a general court martial convened at Baton Rouge La. 2/23/64 on the charge of absence without leave. Found not guilty and acquitted. The proceedings and findings were disapproved in GO No 23 Hd Qrs Baton Rouge 3/26/64 and the soldier released and returned to duty.

The charge of desertion of January 16, 1863 is removed but the record of the fact that he was absent from his command without any authority from January 18, 63 to February 8, 1864 cannot be expunged
